Legislative Session 2001-2002
As the result of the activity by Eternal Justice and the mobilization of the consumers by Eternal Justice legislation was introduced, regulating cemeteries and funeral homes in the state of Alabama. The consumers of the state can claim victory with the passage of House Bill 53 substituted by Senate Bill 49 which will require the trusting of all perpetual care funds, as well as all pre need funds. This bill will dictate the operations of both funeral homes and cemeteries in the state. THIS IS A FIRST FOR THE STATE OF ALABAMA. SEC.27-17A-19 STATES NO PERSON SHALL ENGAGE IN THIS STATE IN ANY TRADE PRACTICE WHICH IS ADDRESSED IN THE ALABAMA DECEPTIVE TRADE PRACTICES ACT (SEC. 8-19-1 ET SEQ.) OR AS DETERMINED PURSUANT TO THIS CHAPTER TO BE AN UNFAIR METHOD OF COMPETITION OR AN UNFAIR OR DECEPTIVE ACT OR PRACTICE. THUS THE RIGHTS OF THE CONSUMER HAVE BEEN PROTECTED. LEGISLATION IS ONLY AS GOOD AS THE MECHANISM FOR ENFORCEMENT.
